1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the services, classes, workshops, sessions, lessons, and related offerings provided by Northline Drawing Atelier, located at 214 Queen Street West, Toronto, ON M5V 1Z2, Canada (“Northline Drawing Atelier,” “we,” “us,” or “our”). By registering for, booking, attending, purchasing, or otherwise using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our services. If you are using our services on behalf of another person, organization, or minor, you represent and warrant that you have the authority to bind that person or organization to these Terms.

2. Scope of Services

Northline Drawing Atelier is a drawing-studio offering the following services, which may be delivered in-person, online, or in a hybrid format as determined by us:

We may modify, suspend, or discontinue any service, instructor, schedule, format, venue, or curriculum at any time, subject to applicable law and any specific written agreement with you.

We do not guarantee any particular artistic outcome, skill level, admission, employment result, portfolio acceptance, or commercial success. Any examples, demonstrations, critiques, or feedback are provided for educational purposes only.

3. User Obligations and Responsibilities

By using our services, you agree to:

You are responsible for any damage you cause to studio property, equipment, or the property of others, except to the extent caused by our negligence or willful misconduct as determined under applicable law.

You acknowledge that participation in drawing activities may involve the use of sharp tools, easels, stools, charcoal, solvents, and other materials that can present risks of injury, staining, allergic reaction, or property damage. You agree to use appropriate care and follow all safety instructions.

4. Payment Terms and Conditions

Fees, pricing, taxes, and payment methods will be disclosed at the time of booking, purchase, or registration, or otherwise made available by Northline Drawing Atelier. All amounts are stated in Canadian dollars unless otherwise indicated.

If a payment is reversed, charged back, or disputed without valid basis, we reserve the right to suspend your access to services and recover any associated costs, to the extent permitted by law.

5. Cancellation and Refund Policy

Our cancellation and refund policy applies subject to any mandatory consumer protection laws in Ontario and Canada. If a more specific policy is provided at the time of booking, registration, or purchase, that policy will apply in addition to these Terms.

We may deny refunds where services have already been delivered, where materials have been provided, where a participant has violated these Terms, or where the request is otherwise inconsistent with applicable law or a stated booking policy.

6. Liability Limitations

To the fullest extent permitted by applicable law, Northline Drawing Atelier, its owners, directors, officers, employees, contractors, instructors, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of opportunity, or business interruption, arising out of or relating to your use of our services.

To the fullest extent permitted by law, our total aggregate liability for any claim arising from or related to the services shall not exceed the amount you paid to Northline Drawing Atelier for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to the claim, or CAD $100, whichever is greater, except where such limitation is prohibited by law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, intentional misconduct, or any other liability that cannot lawfully be excluded.

You acknowledge that participation in studio activities is at your own risk, and you are responsible for determining whether you are physically and mentally fit to participate. If you have any medical condition, allergy, injury, or other concern that may affect your participation, you should consult a qualified professional before attending.

7. Intellectual Property Rights

All content, materials, lesson plans, handouts, images, text, logos, designs, videos, recordings, and other intellectual property made available by Northline Drawing Atelier remain the property of Northline Drawing Atelier or its licensors, unless otherwise stated.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our materials solely for your personal, non-commercial educational purposes, subject to these Terms and any additional restrictions communicated by us.

You may not, without our prior written consent:

Unless otherwise agreed in writing, you retain ownership of original artwork created by you during our services. However, you grant Northline Drawing Atelier a non-exclusive, royalty-free, worldwide license to use photographs or images of your artwork for promotional, educational, archival, or marketing purposes, only where we have obtained your consent or where such use is otherwise permitted by law.

8. Data Protection and Privacy

We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), and any applicable provincial privacy laws.

We may collect personal information such as your name, contact details, booking information, payment-related information, attendance records, and communications with us for purposes including:

We take reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Where required, we may use third-party service providers for payment processing, scheduling, communications, analytics, or other operational functions. These providers may process personal information on our behalf subject to contractual and legal safeguards.

9. Force Majeure

Northline Drawing Atelier shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to acts of God, fire, flood, severe weather, epidemic, pandemic, public health emergency, labour disputes, power outages, internet or telecommunications failures, government orders, war, civil unrest, supply shortages, or venue unavailability.

In the event of force majeure, we may, at our discretion and subject to applicable law, reschedule services, provide credits, modify delivery methods, or cancel affected services without liability beyond any remedies required by law.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our services, operations, legal requirements, or business practices. The updated Terms will be effective when posted or otherwise communicated to you, unless a later effective date is stated.

Your continued use of our services after any change constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.

11. Applicable Law and Jurisdiction

These Terms and any dispute arising out of or relating to them, our services, or your use of our services shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute, claim, or proceeding arising from or relating to these Terms or our services, subject to any mandatory consumer protection rights or other non-waivable rights under applicable law.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or other competent authority, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

If any invalid or unenforceable provision can be modified to make it valid and enforceable, it shall be deemed modified to the minimum extent necessary to achieve that result while preserving the original intent as closely as possible.

By booking, registering for, attending, or using the services of Northline Drawing Atelier, you acknowledge that you have read and agree to these Terms of Service.
